Apple, Mac Cloner Agree to Settle Lawsuit; Psystar Still Kicking

picture-6Apple and Mac cloner Psystar have agreed to settle a 17-month lawsuit, which will prevent Psystar from selling PCs preinstalled with the Mac operating system. However, Psystar isn’t completely surrendering.

As part of the settlement, the Mac cloner said it will pay Apple an amount of damages that has yet to be specified. In the Monday filing, Psystar argued to exclude Rebel EFI, a $50 piece of software that the company started selling in October, from any potential injunction. Rebel EFI is a program that enables owners of some Intel PCs to install Mac OS X onto their systems.

An excerpt from the court document [pdf] filed Monday by Psystar follows:

Psystar and Apple today entered into a partial settlement that is embodied in a stipulation that will be filed with the Court tomorrow. Psystar has agreed on certain amounts to be awarded as statutory damages on Apple’s copyright claims in exchange for Apple’s agreement not to execute on these awards until all appeals in this matter have been concluded. Moreover, Apple has agreed to voluntarily dismiss all its trademark, trade-dress, and state-law claims. This partial settlement eliminates the need for a trial and reduces the issues before this Court to the scope of any permanent injunction on Apple’s copyright claims.

The summary judgment in this case turned on the manner in which Psystar assembled its Open Computers.  It turned on such things as the use of the Psystar imaging station and what this Court found to be the creation of multiple copies and derivative works of Mac OS X along the way….  None of these same facts is involved in Rebel EFI.  Rebel EFI is entirely a software product.  It does not involve the assembly by Psystar of any computers…. Nor does Rebel EFI contain or include Mac OS X.  A Mac OS X DVD does not even accompany sales of Rebel EFI.  Rebel EFI consists solely of Psystar software available for sale and download through Psystar’s website.  In particular, whether sales of Rebel EFI are lawful or not depends on whether Psystar’s end users have a defense under 17 U.S.C. § 117.  This issue has not been litigated in this case at all.  Psystar’s end users do not engage in commercial use of Mac OS X and their use would qualify as use for “internal purposes” even under the standards articulated by Apple in its summary-judgment briefing.  If Psystar’s end users are protected by § 117, then Psystar cannot be violating the DMCA by selling Rebel EFI because Rebel EFI, as used by the end users, does not facilitate infringement.

In short, Psystar wishes to continue providing a DIY solution for owners to make their own Mac clones, thereby shifting the responsibility (i.e., breaking Apple’s End User License Agreement) onto the consumer.

However, it’s unlikely this workaround will pan out for Psytar. In 2008, Wired.com reported on a company called Open Tech, which said it would sell PCs bundled with instruction kits for consumers to install Mac OS X themselves. However, Carole Handler, an intellectual property lawyer with Wildman Harrold, told Wired.com that Open Tech would be subjecting itself to contributory infringement of Apple’s end-user agreement.

“Making the user instead of the company the perpetrator of any violation will not avoid the issue of a new company’s contributory infringement and/or vicarious liability for what it facilitates and enables the user to undertake,” Handler said in an e-mail interview. “This kind of workaround is not a bar to Apple bringing contributory infringement or vicarious liability claims.”

Though slightly different, Psystar’s solution could also be considering aiding the consumer to break Apple’s EULA, which reads, “You agree not to install, use or run the Apple Software on any non-Apple-labeled computer, or to enable others to do so.”

Psystar, a company based in Florida, opened its Mac clone business in April 2008. Three months later, Apple filed a lawsuit alleging Psystar was committing copyright, trademark and shrink-wrap license infringement. Judge William Alsup in November ruled that by selling PCs hacked to run Mac OS X, Psystar had violated Apple’s copyrights.

Some Palm Pre Profiles Get Lost in the Cloud


Several Palm Pre customers have reported major problems with their handset’s online backup system, resulting in the loss of phone numbers, calendar events, memos and other data.

The issue stems from corrupted backups, according to Pre enthusiast blog PreCentral. The Pre backs up its data as a “Palm Profile” online, and it only stores the most recent backup. That means if the most recent backup becomes corrupt, Pre owners could not revert to an earlier, non-corrupt profile.

“We are seeing a small number of customers who have experienced issues transferring their Palm Profile information to another Palm webOS device,” a Palm spokesman said in a statement. “Palm and Sprint are working closely together to support these customers to successfully transfer their information to the new device.”

Though Palm says only a small number of customers were affected, the PreCentral blog said it had received several tips throughout the day suggesting this was a widespread issue. Recently, T-Mobile Sidekick owners faced a similar problem. Microsoft, T-Mobile and Danger hosted the data of all of T-Mobile’s Sidekick users in the cloud, and recently the server crashed, losing everything. These incidents are rare, but they underscore the risk of trusting a third party to secure your data over the web.

What was first unveiled exclusively on the Motorola Droid is now available to the rest of the Android gang. If you’ve got an Android phone running version 1.6, you’ll be able to download the new Google Maps Navigation application for free off the Android Market from today.

Android 1.6 phones in the US currently include the currently available T-Mobile mytouch 3G, the G1 and the HTC Tattoo, as well as the Sony Ericsson Xperia X10. However handsets like the HTC Hero, Droid Eris, Samsung Moment and the Samsung Behold II all run Android 1.5 so won’t be getting the new feature.

While you will get features like turn by turn voice guidance and automatic rerouting, some features of Android 2.0 are not available on Android 1.6, for example, the ability to use the “navigate to” voice command. Nevertheless, if you’re an Android user with the eligible phones mentioned above in the US, you’re definitely in luck and the likes of TomTom, Garmin will no doubt be banging their heads against the wall with this news. If you’re in the UK / non-US, it looks like there could be an unofficial way to get this working on your Android phone, this will mean abit of tweaking around but watch this space.

Apple VP Defends iPhone’s App Store Approval Policy


Though indisputably successful, the iPhone’s App Store has been at the center of controversy for Apple this past year. In a rare move, the company’s vice president of marketing Phil Schiller spoke on the record to defend the App Store’s review policies.

Apple has approved over 100,000 iPhone apps to date, but some questionable rejections have brought the company under fire. Among concerned developers, Joe Hewitt, developer of the popular Facebook iPhone app, spoke loud and clear that he would no longer develop for the iPhone because he disapproved of Apple’s review process.

“I am philosophically opposed to the existence of their review process,” Hewitt told TechCrunch. “I am very concerned that they are setting a horrible precedent for other software platforms, and soon gatekeepers will start infesting the lives of every software developer.”

In an interview with BusinessWeek, Schiller (right) explains why Apple has an App Store review process. In short, he said it’s necessary to ensure iPhone customers get what they’re promised. He noted that 10 percent of app rejections are related to “inappropriate” content, while 90 percent have to do with technical fixes, such as bugs. His third main point is that the App Store has an international audience, and thus several governments and political leaders are asking the company what it’s doing to ensure children are not downloading inappropriate content.

“We’ve built a store for the most part that people can trust,” he said. “You and your family and friends can download applications from the store, and for the most part they do what you’d expect, and they get onto your phone, and you get billed appropriately, and it all just works.”

Video Demonstrates Wired’s Concept iTablet App

Who takes Apple’s rumored touchscreen tablet seriously? Wired’s parent company Condé Nast. Earlier this week, the corporation revealed its plans to work with Adobe to repurpose magazine content for upcoming digital devices, including the Apple tablet (if it is indeed real). The first mag to get the tablet treatment, of course, is Wired.

All Things Digital’s Peter Kafka first reported that news, and he said he was trying to convince Condé to share a video demonstrating the tablet app. Well, here you go. The video above was shot at the Wired Store promotional event currently being held in New York. On display there is a concept video of Wired’s “iTablet” app.

To me, the most interesting part appears around the 30-second mark, where we can see an animated, interactive graphic. Exciting to think about the potential for this hypothetical new format, isn’t it?

Pantech Impact to arrive in US from AT&T

pantech-impactPantech intends to create an impact among cellphone users in the US with their latest release from AT&T – ironically, the cellphone itself has been named “Impact” for obvious reasons. This being the second Pantech handset to arrive in store shelves this coming holiday season, you will be able to choose from a couple of colors, where they are bright blue and soft pink. This cellphone will sport a totally new form factor that has never been found in AT&T’s stable of quick messaging phones, boasting a high-gloss faceplate with a haptic response touchpad, a couple of displays to keep up with the current trend, a full hidden keyboard as well as a bunch of the latest social and multimedia options to make sure that Gen Y folks remain connected in a fun manner all the time.

Impact offers a totally new user experience right from the get go, where its shiny blackout exterior is surrounded by textured blue or pink detailing. Every time the touchpad which is located below the screen is pressed, it will automatically spring to action, coaxing your hand to provide the finger taps it so craves in order to “answer” with a soft, tactile buzz. This allows the Impact to play and control music, make a call, or send texts without the need to open the phone.

The Impact also comes with a sideways flip that opens up to reveal full QWERTY keyboard which makes it a snap to compose those long winded emails to your Aunt Martha in a flurry, while even traditionally long text messages would fall prey to your brilliantly fast fingers as they dance across an all-too-familiar keyboard layout. Apart from that, you will also get a range of shortcut keys that make room for one-touch access to IM, text, email, and switching between applications. The second full-color display screen is great for viewing videos, friends’ profiles and flipping through images, while either side of the display houses speakers that makes tuning in to your favorite songs a joy. The Impact will retail for a surprisingly affordable $99.99 after a $50 mail-in rebate for a new 2-year contract.
